Sorry guys, but enough is enough

No matter how positive I try to be, some people will always try and pick fault. But when the site owner tells you to accept things or f&@k off then what can you do. I have made a lot of friends on nwb and will be grateful for that, but the dynamic has changed so I'm going to accept mr nwb's advice and f£&k off. All the best for everyone in the future. Later

ive been upset the last couple of weeks at a lot of the fuss on here, but look at all these great people on here and superb community, and nasty stuff is in the minority, i am still distressed about all these stuff over the last couple weeks but i really feel controversy is over the worst and things are now getting back to the good ol days :-)

I hope none is directed at me.....???
I put a purely constructive blog on about a venue, who have a history of pissing bands around - letting fellow bands know.......
1) lets other bands know to beware
2) lets other venues know that word very quickly gets around if they try to........

and Vice Versa....... venues can warn other venues...... say if a particular band had a history of cancelling gigs at the last minute

Simples........ Stick around Scott

Nah, a thread I commented on has evaporated so it's probably me. I pointed out that the aggro on the thread asking for original bands was started by the insulting comments in subsequent replies rather than the original request for bands.

@ mr nwb-am i correct in saying that, as per t&c's, on our profiles any comments, opinions, etc. are solely our responsibility and are not subject to deletion/scrutiny by any of the moderators, or yourself (within legal requirements,of course), and, along with p.m's are acceptable means of communicating any strongly held opinions? :-)

Scott. Take a step back and calm down. There's no censorship per se, but you can't have people throwing around comments like those that have been circulated over the last few days. It's NWBs reputation at stake. I feel for Paul. He's been put in an awkward position by the minority who can't see the bigger picture.

May I just ask exactly what are the legal implications of a band stating facts about a venue who have cancelled them for no good reason?

Best wishes

John

# Posted by ST Photography - VIVA LA COMMU... - 01/12/2009, 18:55 (GMT)

@ Viking: NWB and its designates shall have the right, but not the obligation, to remove any content that violates the TOS or is otherwise objectionable

@ John FV: It's not so much the legal implications as the moral obligation to make this site accessible/suitable for bands, venues and fans and maintain the spirit with which it was intended to operate. It is one thing to state fact, it is quite another to insult people.

# Posted by John Wilkinson: - 01/12/2009, 18:58 (GMT)

Ok got that but as I see it if I state a fact about a venue which has cancelled my band a week prior to a booking which has been arranged this could be removed so as not to upset the venue. Is that correct?

Best wishes

Ok so if a band insults a venue it can be removed but if another individual insults a genre of bands it can stay?

Avatar

# Posted by ST Photography - VIVA LA COMMU... - 01/12/2009, 19:18 (GMT)

@ John FV. I can't help but think you're making this more complicated than it needs to be. I'm sure you have enough common sense and a moral compass capable of telling you what is acceptable and what isn't. Taking it at "face value" insulting a venue is possibly slander/defamation and leaves the individual and NWB liable to action. Insulting a genre is opinion and I'm not sure who the affected party would be. I'd have to see details.

Oh yes, and your question evolved from posting facts about a venue to insulting a venue. Very, very different proposition.

# Posted by HAPPY DAIZE - 01/12/2009, 19:23 (GMT)

I'm kinda on John FV's side here.
Many of the bands on here operate on a verbal contract with the venue. If a venue cancels at the last minute or for no reason, then I would like to be informed of this.2 of the members of Happy Daize only have music as their income, so a last minute cancellation without reason (other than some kind of 'force majeure') means some kind of financial hardship, and without some kind of compensation, I find that unfogivable.
Likewise, however, if a band upsets a venue in any way (by playing too loud/being rude/causing damage, etc.) then I also think the venues have a right to know.
Just my opinion, you understand, but it's all about professionalism.

Rob

# Posted by John Wilkinson: - 01/12/2009, 19:28 (GMT)

But how is stating the facts about a venue slanderous? They did cancel with a weeks notice and without good reason. That is a fact and you cannot be sued for slander if you state a fact.
My compass and common sense are fine matey trust me, I am more concerned that this site is becoming over moderated which will mean that members like Scott will leave in their droves and the site will die.
I find it interesting that an obvious troll can insult bands on here and have his posts left up but should we dare to have a pop at a venue for acting poorly we get either spoken to as if we are children or the posts are removed.
All musicians I know are passionate people who give their talent and time to ENTERTAIN. It doesn't matter what you play ( covers or originals) we all work bloody hard to give the beat show we can.
If we are not free to at least offer opinions on venues and such, what's the point of the site?

Best wishes

John

# Posted by ST Photography - VIVA LA COMMU... - 01/12/2009, 19:29 (GMT)

@ Rob: I accept most of what you're saying. I don't know about cancellations from either side being "unforgiveable", but they are certainly an accepted risk that we all concede when entering into verbal contracts.

In my opinion, incidents regarding venues/bands (and even fans!) should be reported so that 3rd parties can act as they see fit. It is unwise in my opinion to go beyond that.

# Posted by John Wilkinson: - 01/12/2009, 19:32 (GMT)

And by the way If we ever let a venue down last minute ( and we have not done so in ten years of this bands life ) I would expect the venue to come on here and say what a bunch of gits we are.

Works both ways

@ John FV: I think I already answered that quesiton. No problem with reporting fact, but some people went (and continue to go) beyond that. If you feel strongly about a post, report it to Mr NWB. I'm sure he will deal with it. As for me, I will continue to post opinion whilst still adhering to the T&Cs for the site. It is possible.

Seen this happen before on other message boards/forums - in fact this happens on an almost monthly basis on a well known drum forum I go on. The thing is when a public discussion board becomes so popular it's bound to cause dissagreements amonst its many members - its then when the site owner/moderators have to step in and I have to agree. There's a place to get personal and a place to discuss the music we all love on a business level, sounds like I'm sitting on the fence but I'd hate to see a bloody good site built for us go down the pan. Please remember that every page of posts on here is being cached by Google, if a venue or fan searched for your band you don't want them to land on the wrong page do you?

It says "NWB is a free resource for bands, venues and fans to promote gigs, listen to music, and to make friends with like minded people" on the front page.
We have had some great contacts from this site and made some great friends ... I've listened to some original music, sought and obtained advice and its my first stop when i log onto the internet. I dont much care for all the other stuff and for the most part, ignore it. Ultimately people are entitled to their own opinions - it doesnt matter to me, i like what i do (in a covers band) and know people appreciate our music .... if Mr Dalek came to one of our gigs i would try my utmost to convert his views (and would like to think we could!) im sure we would have a bit of a laugh then we'd be on our own respective ways!
Whatever!
I'd simply like to see the site remain as intended - as per the front page!
Keep it real - keep it about music but lets not be too serious :-)

Cheers
Steve.

I'm coming to this late ... been out to see a top covers band ... From The Jam ... 1 third of the original band, Mr Bruce Foxton, quite the little dynamo ... excellent - but was it a covers band or an originals band??

Anyway ... did I miss something or did Social Tornado become the spokesperson / moderator / guru of this wonderful site - or do we still answer to Mr Bands??

Just that two (at least) initial questions posed on this blog have been answered in a very officious manner by ST.

Do we need to know more about this??

No criticism implied - just answers requested - but from the site owner/moderator/admin - not one of the many members.

I think ST is just passionate about the site, and has always been an advocate of keeping stuff on NWB 'on topic'. I was in a band with ST, so he knows me well, and generously been trying to answer peoples questions whilst im away from the site

If you have any issues with NWB, please contact me directly - this site might not be here in its current state for much longer - Which will be good for me, but possibly not for the NWB masses.

If you look at the time, its 2.22am! and im still running round sorting out NWB emails and PMs e.t.c

it wont be the same till scotts back on here, im proud to call him my friend and hes an absolute gent,i look forward to him coming back soon, we need to try and move away from recent controversy on here, to listen whats said, all look at the terms again individually and remember what we like about the site and what keeps us coming back day after day, i have to admit i have nearly left as well over the last week or so , not over the issue of comments being deleted etc, over coming on and seeing arguments time and time again, and while trying to ignore it,

im a sensitive geezer its not failed to affect me and mar in my opinion a great site, maybe i am naive not to expect differences of opinion on a forum, that has always been on here , just that lately the dynamic of it seems to have changed, and is currently leaving me seriously disillusioned which is the last thing i want, but like anything on here this is just my own opinion and feelings.

hopefully it will soon change for the better and get back to how it was, lets ALL use this as a heads up

Jeez.....I think it is really sad that it has come to all of this but, to be honest, I'm not surprised.

I think people need to stop and think before they make their thoughts go public. Its so easy to think your just having a laugh, but peoples lives do get affected.

I was once slated on this site for cancelling a gig. People were quick to jump in and put their opinions accross. So what happens when you guys have problems and cancel a gig at the last minute....the response is usually the opposite...oh poor you, what a nightmare, chin up etc etc etc. This is life, and yes some people have no consideration for others and cancel for wrong reasons etc, but it does work both ways and it is not wise to put that up for public debate - when really who knows the full story (them, theirs & the truth)........

My own situation was totally out of my control and it would not have been wise for me to have posted all the details for the public eye. Yes, the guy did try to take me to court and failed on 2 occasions. Through posts on this site it did have an effect on our business, with bands just not showing up etc....Under certain legal clauses, I was advised to turn the action against the claimant......would I be so sad....NO NO NO!!!! What I did was just avoid NWBs and thought I just wont book any bands from the site again. Obviously as the months went on, I realised that this was stupid as there were many bands supporting me, wishing me luck with the issues I had and sticking up for me, so why should I let this one incident affect both our business and the bands connected to this site....

People do have a right to voice their opinions, but sometimes that is all it is 'an opinion.' I totally understand both sides of this debate and the legal implications it may have for Mr NWB (I could have easlily reversed the charges against us for cancelling a gig and pursed the claimant for far more than the original claim). Its all about being diplomatic and being able to see a wider picture..... and remain professional!!!!!!

Cyber bullying is the biggest form of bullying in todays society. I thought it was just children we had to reach out to....but are we as adults just as guilty? This site is for bands, venues and fans! Obviously the ratio of bands is far more than venues & fans so does certain debates become one sided?

This is a fantastic community and after a s**t shift there is nothing more enjoyable than coming on here and having a laugh. Lets keep it that way guys and dont get personal in a way that could affect Mr NWB, the future of the site, individuals and businesses.

Luv an hugs xxxx

Ps....just for the record, whilst the claim was being made against us, our legal team (through their decision, not ours as we would have NEVER taken matters up) were keeping a close eye and recording from this site.....YOU NEVER KNOW WHO IS WATCHING AND/OR TAKING NOTES.......

@The Old Bank Inn - Top stuff!!

I get annoyed when bands ask me to remove a venue from NWB just because theyve had a bad experience in bookings/cancellations.

In that school of thought I should also be deleting all the crap bands off NWB so venues dont get ripped off by duff bands...

Might only be a couple bands left on the site :-) lol!! *joking*
